Practitioner Terms of Engagement

These Terms of Engagement set out the basis on which you (the “Practitioner”) provide services via Return Well (“we”, “us”, “our”). They apply to all qualified UK clinicians who deliver assessments through Return Well, including Occupational Therapists, Psychologists, Occupational Health Nurses, Physiotherapists, Case Managers and other suitably qualified clinicians. By accepting referrals through Return Well, you agree to these terms.

1. Independent Contractor Status

  • You operate as an independent, self-employed contractor.
  • Nothing in this agreement creates an employment, partnership, or agency relationship.
  • You are responsible for your own tax, National Insurance, pension, and financial obligations.

2. Professional Responsibility

  • You retain full responsibility for all clinical decisions, assessments, and professional opinions.
  • You are solely responsible for the clinical opinions, recommendations and reports you produce.
  • You must exercise independent clinical judgement at all times.
  • All work must be delivered in line with applicable professional, ethical, and regulatory standards.
  • Return Well provides a referral platform and administrative support only. It does not provide clinical services, and does not supervise or direct clinical practice.
  • Return Well does not direct or influence clinical decision-making.

3. Registration, Qualifications & Insurance

You must:

  • Maintain current registration with the UK regulator appropriate to your profession (HCPC for Occupational Therapists, Physiotherapists and Practitioner Psychologists; NMC for Occupational Health Nurses; or equivalent recognised UK body), for the whole time you accept work through Return Well.
  • Maintain valid professional indemnity insurance covering the work you carry out through Return Well, and provide evidence of that cover on request.
  • Maintain any required continuing professional development (CPD).
  • Notify Return Well immediately if your registration or your professional indemnity insurance lapses, is suspended, is cancelled, or becomes subject to any condition or restriction.
  • Notify Return Well immediately of any change to your fitness to practise, or of any investigation into it.

4. Data Protection & Confidentiality

You agree to:

  • Comply with all applicable UK data protection laws, including UK GDPR.
  • Maintain strict confidentiality in respect of all client, employee, and business information.
  • Use secure systems and communication methods approved by Return Well.
  • Only process personal data for the purpose of delivering agreed services.
  • Immediately report any data breaches or concerns.

5. Service Delivery Standards

You agree to:

  • Deliver assessments in a professional, timely, and client-focused manner.
  • Follow Return Well's report structure, templates, and quality standards.
  • Communicate clearly and appropriately with employees and Return Well.
  • Conduct assessments via agreed methods (e.g. remote consultation unless otherwise specified).
  • Complete all work using Return Well systems and processes.

Expected Service Timeframes

Each timeframe below runs from its own starting point. None of them requires the whole case to be completed within a set number of days of your accepting it.

  • Initial contact: contact the employee within 1 working day of accepting the case.
  • Arranging the assessment: agree an assessment date with the employee within 2 working days of accepting the case.
  • Completing the assessment: aim to carry out the assessment within 3 working days of accepting the case, and normally no later than 5 working days, subject to the employee's availability.
  • Submitting the report: submit your report within 2 working days of the assessment.
  • Amendments: where Return Well's quality review asks for amendments, resubmit within 1 working day of the request.
  • Safeguarding: if you identify an immediate or serious risk, act in line with your own professional and safeguarding duties without waiting for Return Well's approval, record the action you took, and notify Return Well as soon as practicable.
  • You must notify Return Well promptly if you are unable to meet these timeframes.

Timeframes may vary depending on case complexity, employee availability, or clinical considerations. Delays caused by the employee's availability or response do not count against you.

6. Scope of Work

  • Each referral will define the agreed scope of work.
  • You must not exceed this scope without prior agreement from Return Well.
  • Any additional work must be approved in advance.

7. Quality & Professional Standards

  • Reports must be clear, structured, and focused on functional work impact.
  • Recommendations must be practical, proportionate, and evidence-informed.
  • You agree to participate in reasonable quality assurance or feedback processes.
  • Return Well reserves the right to request revisions where reports do not meet required standards.

8. Fees & Payment

  • Fees are agreed on a per-assessment basis.
  • Payment will be made following submission and acceptance of the completed report.
  • You are responsible for invoicing where required (if applicable to your model).

9. Liability & Indemnity

  • You are responsible for your own professional practice and advice.
  • Return Well is not liable for clinical decisions or recommendations made by you.
  • You must maintain appropriate insurance to cover your work.
  • You will indemnify Return Well against any claim, loss, damage, cost or expense (including reasonable legal costs) arising from your negligent act, error or omission, or from your breach of these terms.
  • This indemnity is not limited by the amount of insurance you hold, and continues to apply after you stop accepting work through Return Well.

Nothing in these terms excludes or limits liability where the law does not permit it, including liability for death or personal injury caused by negligence, or for fraud.

10. Platform Use & Conduct

You agree to:

  • Use Return Well systems and processes appropriately.
  • Act professionally in all interactions with employees and clients.
  • Not engage in any conduct that may harm Return Well's reputation.

11. Suspension & Termination

Return Well may suspend your access immediately, and without notice, where:

  • Your professional registration lapses, is suspended, or becomes subject to a condition or restriction.
  • Your professional indemnity insurance lapses, is cancelled, or no longer covers the work you carry out through Return Well.
  • You materially breach these terms.

Where access is suspended you will not be offered new cases, and Return Well may reassign any case already allocated to you. Suspension may be lifted once the position is resolved to Return Well's reasonable satisfaction.

Return Well may also suspend or terminate your access where:

  • Professional or quality standards are not met.
  • Service expectations are not maintained.
  • There is a breach of these terms.

You may cease working with Return Well at any time.

12. Amendments

Return Well may update these Terms of Engagement where necessary. Any changes will be communicated in advance.

13. Acceptance

By accepting referrals and providing services through Return Well, you confirm that you have read, understood, and agree to these Terms of Engagement.
